Terms of Use
These Terms of Use ("Terms") govern your access to and use of www.nativeherd.com and any ordering channel operated by The Native Herd, a business operating from 96/2/1, Harshadri Farms, Kantanahalli, Amruthur Hobli, Kunigal Taluk, Tumkur District, Karnataka – 572111 ("we", "us", "our"). By browsing the Platform or placing an order, you agree to be bound by these Terms, which are governed by the laws of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.
1. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to place an order with us. By placing an order, you confirm that the information you provide (name, address, contact details) is accurate and current.
2. Products and Availability
We sell native-breed country eggs, cold-pressed coconut oil, cooking coconuts, dry coconut and seasonal produce. As these are natural, farm-sourced and seasonal products, availability, appearance, size and exact quantity may vary between batches and seasons. We reserve the right to limit quantities, mark items as "Sold Out," or discontinue any product at our discretion, without prior notice.
3. Order Booking and Confirmation
An order is only confirmed once you receive an explicit order confirmation from us via WhatsApp, email, phone or the Platform. Orders are placed by contacting us on WhatsApp, phone or email; the website itself does not take orders or payments. An enquiry does not guarantee availability or reserve stock until we confirm your order. We reserve the right to accept, modify or cancel any order at our discretion — including in cases of pricing errors, stock unavailability, suspected fraud, or inability to deliver to your location — and will inform you promptly if this occurs. Orders are processed on a first-confirmed basis, particularly for seasonal or limited-stock items.
4. Pricing and Payments
All prices listed are in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Prices, including any "Launch Offer" or promotional pricing, may change at any time without prior notice and do not apply retroactively to orders already confirmed. Prices shown on the website are for reference; the final amount, including any delivery charges, is confirmed to you before your order is accepted. We do not collect payments through the website. Payment is made directly to us after confirmation, via UPI, bank transfer, cash on delivery, or any other method we agree with you at the time of ordering. Full payment (or advance payment, where specified) may be required before dispatch for certain orders. We are not responsible for delays or failures caused by your bank, UPI provider or network provider. In case of a failed or duplicate payment, please contact us with your transaction reference for resolution.
5. Delivery
We aim to deliver orders within the estimated timeframe communicated to you at the time of order confirmation; however, delivery timelines are estimates and not guaranteed, and may be affected by weather, seasonal availability, logistics, or circumstances beyond our reasonable control. You are responsible for providing an accurate delivery address and being reasonably available to receive the order. Additional delivery charges may apply depending on your location and order value, and will be communicated before confirmation.
6. Cancellations, Returns and Refunds
Given the perishable and farm-fresh nature of our products, orders once dispatched generally cannot be cancelled, returned or exchanged, except where the product delivered is materially damaged, spoiled, or different from what was ordered. In such cases, please contact us within 24 hours of delivery, with photographic evidence where applicable, and we will assess the issue and, at our discretion, offer a replacement, store credit, or refund. Approved refunds will be processed to the original payment method within a reasonable time, in accordance with the Consumer Protection (E-Commerce) Rules, 2020. Orders cancelled by us (e.g. due to stock unavailability) prior to dispatch will be refunded in full.
7. Customer Responsibilities
You agree to provide accurate order and delivery information, use the Platform only for lawful personal or household purchases, and not to misuse, resell without authorisation, or engage in fraudulent activity in connection with your orders.
8. Limitation of Liability
To the maximum extent permitted under applicable Indian law, our liability in connection with any order is limited to the value of that order. We are not liable for indirect, incidental or consequential loss, or for delays or failures arising from causes beyond our reasonable control, including natural calamities, transport disruptions, or third-party service failures.
9. Intellectual Property
All content on the Platform, including the "The Native Herd" name, logo, text, images and design, is our property or used with permission, and may not be reproduced or used without our prior written consent.
